Terms And Conditions

These terms and conditions outline the rules and guidelines for participating in the survey conducted by Great Manager Institute®. By participating in the survey, you agree to adhere to these terms. Please read them carefully before proceeding with the survey.

1. Eligibility:

  1. Individuals participating in the survey as managers (“Participants”) must be currently employed in a managerial role within the organization.
  2. The respondents to the survey (“Survey Respondents”) must be direct reports of the Participants, the Participant, the reporting manager of the Participant, and peers of the Participant, as applicable.
  3. Organizations participating in the survey (“Organizations”) must be legal entities with a workforce consisting of participants and Survey Respondents.

2. Purpose of the Survey:

  1. The survey aims to assess people managers and recognize and as required, certify exceptional people managers and organizations that excel in fostering a positive work environment, employee growth, and overall well-being.
  2. The survey will be conducted among the direct report of the participating managers, with the aim of gathering feedback about the manager’s leadership qualities and their people management practices.

3. Survey Process:

  1. Participants will provide accurate and truthful information throughout the survey process.
  2. Organizations will ensure that the survey is conducted in a fair and transparent manner, without any form of coercion or manipulation.
  3. The company conducting the survey (“Company”) will provide an online platform (“Platform”) for survey participation and submission of people practices.

4. Confidentiality:

  1. All responses and feedback collected through the survey will be kept strictly confidential. Individual responses will not be disclosed, and only aggregated data will be used for analysis and recognition purposes.
  2. The participating organization will not have access to individual responses of survey respondents.

5. Data Protection and Privacy:

  1. The Company is committed to protecting the personal data and privacy of all Participants and Survey Respondents. The Company will process personal data in accordance with applicable data protection laws, including India’s Digital Personal Data Protection Act, 2023.
  2. Participants and survey respondents agree to provide consent for the collection, processing, and storage of personal data as required for the survey. The Company will collect and use personal data solely for the purposes of the survey, recognition, certification and for research purpose.
  3. Organizations are Data Fiduciary, and they have full consent of their employees to provide their data to us. Consent management between organizations and their employees is beyond the scope of this agreement. The participating organizations are responsible for managing consent of their employees.
  4. The Company will take reasonable measures to ensure the security and confidentiality of personal data collected through the survey. Participants, Survey Respondents and Organizations acknowledge and provide explicit consent for the collection, processing, and storage of personal data as required for the survey.
  5. The Company will collect personal data only to the extent necessary for the purposes of the survey and in compliance with the law. Personal data collected may include, but is not limited to, names, email addresses, job titles, gender, experience, and other relevant information.
  6. Personal data will be retained only for 12 months after announcement of results in the newspaper.The Company will use personal data for the following purposes:
    –  To conduct the survey effectively and gather feedback from Survey Respondents.
    –  To assess people managers and organizations for recognition and certification.
    – To communicate with Participants and Organizations regarding the survey and related matters.
    – To perform data analytics and research for internal business purposes.
    – To conduct research for the improvement of future surveys or related services.- To conduct audits and assessments related to the survey process.
  7. Personal data collected will not be used for any other purposes without obtaining additional consent from Participants and Organizations.
  8. Once the data is no longer required for the specified purposes, it will be securely deleted or anonymized to prevent identification of individuals.
  9. Personal data will be retained only for 12 months after announcement of results in the newspaper.
  10. The Company will not share personal data with third parties unless required by law or for specific purposes related to the recognition. In such cases, the Company will ensure that appropriate data protection agreements are in place with third parties to safeguard the personal data.
  11. Participants and Organizations have the right to access, rectify, or erase their personal data as provided for in the Digital Personal Data Protection Act, 2023. Requests related to data subject rights can be made to [email protected].
  12. In the event of a data breach involving personal data, the Company will adhere to the requirements of the Digital Personal Data Protection Act, 2023, regarding data breach notification. Participants and Organizations will receive notification within 24 hours of the occurrence of a breach.
  13. If personal data is transferred outside of India, the Company will ensure that the recipient country provides an adequate level of data protection or implement appropriate safeguards as required by the Digital Personal Data Protection Act, 2023.
  14. The Company will maintain records of data processing activities as required by the Digital Personal Data Protection Act, 2023.
  15. The Company will conduct data impact assessments as necessary to assess and mitigate risks to the privacy and rights of Participants and Survey Respondents.
  16. The Company will have a comprehensive Data Protection Policy in place that outlines its data protection practices, procedures, and compliance with the Digital Personal Data Protection Act, 2023.

6. Consent and Release:

  1. By participating in the survey, Participants and Organizations grant the company conducting the survey the right to use aggregated data for recognition and certification purposes.
  2. Participants and Organizations understand that recognition for Manager or Organization does not imply any endorsement or liability on the part of the company conducting the survey.

7. Compliance with Laws and Regulations:

  1. Participants and Organizations agree to comply with all applicable laws and regulations during their participation in the survey.
  2. Participants and Organizations will not engage in any fraudulent activities or attempts to manipulate the survey results.

8. Recognition and Certification:

  1. The company conducting the survey reserves the right to determine the criteria for recognition and certification for Managers and organizations.
  2. Recognition and certification decisions will be final and not subject to appeal,

9. Survey Content:

  1. The survey questions will be relevant to the purpose of the research and will not include inappropriate or offensive content.
  2. The survey organizer reserves the right to exclude responses that appear to be fraudulent, spam, or not in accordance with the survey guidelines.

10. Intellectual Property:

  1. Participants and Organizations acknowledge that any content submitted through the Platform, including people practices and other materials, shall remain the intellectual property of the respective submitting party.
  2. By participating in the survey, Organizations and Participants grant the survey organizer the right to use the data and insights obtained for research and analysis purposes.
  3. All survey content, including but not limited to questions, design, and branding, are the intellectual property of the survey organizer and are protected by applicable copyright and trademark laws.

11. Limitation of Liability:

  1. Participants and Organizations agree that, to the fullest extent permitted by applicable law, the company conducting the survey, its officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising out of or related to participation in the survey, recognition or certification, or any other matters related to the survey.
  2. Participants and Organizations acknowledge that the company conducting the survey makes no representations or warranties, express or implied, regarding the accuracy, completeness, or reliability of the survey results, recognition, or certification.
  3. Participants and Organizations further acknowledge that any decisions made based on the survey results, recognition, or certification are at their own risk and discretion.

12. Indemnity:

  1. Participants and Organizations agree to indemnify, defend, and hold harmless the company conducting the survey, its officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorney’s fees) arising out of or in connection with:
    • Their participation in the survey;
    • Any breach of these terms and conditions;
    • Any violation of applicable laws, regulations, or third-party rights;
    • Any claims, disputes, or actions brought by third parties related to their participation in the survey or recognition of the Participant or organization.
  2. The company conducting the survey reserves the right to assume the exclusive defense and control of any matter subject to indemnification by Participants or Organizations, in which case Participants and Organizations agree to cooperate fully with the company’s defense.

13. Online Platform Usage:

  1. Participants and Organizations acknowledge that the survey will be conducted through an online platform provided by the company conducting the survey (“Platform”).
  2. Participants and Organizations are responsible for ensuring that they have access to the necessary technology and internet connection required to participate in the survey through the Platform.
  3. The company conducting the survey shall take reasonable measures to ensure the security, confidentiality, and integrity of data collected through the Platform. However, Participants and Organizations acknowledge that no online platform can be completely free from vulnerabilities and risks.
  4. Participants and Organizations agree not to engage in any unauthorized access, tampering, hacking, or disruption of the Platform or the survey process. Any such actions may result in immediate disqualification and potential legal consequences.
  5. Participants and Organizations agree to use the Platform in a lawful and ethical manner, refraining from uploading, sharing, or transmitting any content that is defamatory, offensive, discriminatory, or violates any applicable laws or regulations.
  6. Participants and Organizations retain ownership of the content they submit through the Platform for the survey. However, by submitting content, Participants and Organizations grant the company conducting the survey a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display the content for the purpose of positive recognition.

14. Payment, Refund and Delay in Project Initiation

               A. For Organisations:

  1. Payment terms:
    1. Organizations registering for participation in the Study (“Registered Organizations”) are required to make the necessary payments as outlined in the invoice.
    2. The registration fees must be paid in full before launch of survey or 30 days from the date of raising of invoice by the company, whichever is earlier. Failure to make the payment by the deadline may result in the cancellation of the organization’s participation in the survey unless approved by the concerned person of the company in writing.
  2. Refunds:
    1. Registered Organizations are eligible for a full refund if they choose to withdraw their participation within 15 days from the date of accepting these terms and conditions, provided that payment was made before the withdrawal. If withdrawal occurs between 15 and 30 days from the date of acceptance, a 50% refund of fees will be granted.
    2. Once approved, refunds will follow the internal payment processing schedule of the company and may entail administrative fees or deductions to the extent of any costs already incurred by the Company on account of the Registered organization.
    3. Refunds will not be granted for registration fees after 30 days from the date of accepting these terms and conditions.

    3. Delaying Project Initiation:

    1. In the event that a Registered Organization needs to delay the initiation of the survey participation after completing the registration and payment process, the organization must notify the Company in writing as soon as possible.
    2. The Company will consider requests for project initiation delays on a case-by-case basis. Approval of such requests will be at the discretion of the Company and may be subject to availability and scheduling constraints.
    3. If a project initiation delay is approved, the Company and the Registered Organization will agree upon a new project initiation date. Any changes to the project timeline may be subject to additional charges or adjustments, as determined by the Company.
    4. In case of any delay of the survey start date by the Company, the Registered Organization will be entitled for a full refund.

      B. For Participants
  1. Payment Terms:
    1. Individual customers participating in the survey are required to make the necessary payments as specified during the registration process.
    2. The registration fees must be paid in full at the time of registration.

      2. Refund Policy:

    1. Participants who wish to cancel their participation and request a refund must do so within 24 hours from the time of registration to be eligible for a full refund.
    2. Refund requests must be submitted in writing to mail ID [email protected] within the specified 24 hours window. The Company reserves the right to review and approve refund requests on a case-by-case basis.
    3. Once approved, refunds will be processed using the original payment method and may be subject to administrative fees or deductions as per the Refund Policy.
    4. No refunds will be provided for registration fees after 24 hours from the time of registration.

3. Delaying Project Initiation for Particpants

    1. If a Participant needs to delay the initiation of their survey participation after completing the registration and payment process, they must notify the Company as soon as possible.
    2. Requests for project initiation delays from Participants will be considered on a case-by-case basis. Approval of such requests will be at the discretion of the Company and contingent upon availability and scheduling considerations.
    3. Upon approval, the Company and the B2C Participant will agree upon a new project initiation date. Any adjustments to the project timeline may incur additional charges or modifications, as determined by the Company.

15. Rights of the Company

  1. The Company reserves the right to cancel the registration process of the Participant or the Organization at any time during the process, without assigning reasons thereof. In all such cases the Participant and/ or the Organization will be entitled to a full refund of any fees paid within 30 days of cancellation.

16. Modification of Terms:

  1. The company conducting the survey reserves the right to modify these terms and conditions at its discretion. Participants and Organizations will be notified of any changes.

17. Governing Law and Jurisdiction:

  1. These terms and conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Mumbai.

By participating in the survey, Participants and Organizations acknowledge that they have read, understood, and agreed to these terms and conditions.
